Foreclosures are primarily handled out of court.

The foreclosure process can take 3-14 months depending on the length of the redemption period. The typical foreclosure takes about eight months.

So what happens during ? Court foreclosures are permitted in any sate.However, most mortgages contain a clause enabling a lender to sell a property out of court once a borrower defaults.

While Michigan law does not require that a lender send out a default notice to the borrower before scheduling a foreclosure sale, the mortgage may require the notification. The borrower’s right to stop the foreclosure by paying off the default is also dictated by the mortgage.

Changes to the foreclosure laws have eliminated the owner redemption period here in Colorado effective July 1, 2007. These changes were made last May by the growing concern of legislature for the number of foreclosures and how they should be handled.

During the redemption period, you may free the property from the judgment by paying the amount of your debt, accrued interest and costs to the court by obtaining financing from other sources.

It may be possible to negotiate a lesser amount that the creditor will agree to take for refinancing. It also is possible prior to judgment or during the redemption period for you to choose other remedies available through federal bankruptcy law (discussed in other parts of this guide).

These options may enable you to keep parts of your property or restructure your debts and should be discussed with your attorney.
